The US SEC Netted $8.2B In Penalties Despite Fewer Cases In 2024
  • $8.2 billion in total penalties and investor relief collected, which is setting a new record for returning illicit gains to harmed investors.
  • Gensler is set to step down in January 2025. Under his leadership so far, 124 individuals have been barred from serving as public company officers.
  • The SEC fined 70 firms a total of $600M for failing to monitor employee messaging on platforms like WhatsApp.

The U.S. Securities and Exchange Commission (SEC) may face heat for its crypto crackdown, but its enforcement stats tell a striking story. Despite its stringent approach toward cryptocurrency regulation, the agency achieved a record high in penalties and investor compensation in fiscal year 2024.

In fiscal 2024, the SEC collected a record-breaking $8.2 billion in fines and investor reimbursements. Surprisingly, this milestone came as the number of enforcement cases dropped 26% compared to the previous year. The SEC pursued 583 actions, focusing on impactful cases with massive financial penalties.

SEC Hits Record Mainly Due To Massive Settlement with Crypto Firm Terraform Labs

The SEC Chair Gary Gensler is stepping down after presiding over a historic enforcement period marked by record-breaking penalties.

A significant portion of this was tied to a multibillion-dollar judgment against Terraform Labs and its founder, Do Kwon. The firm’s 2022 collapse, which erased billions in investor funds, led to its conviction for fraud.

Under Gensler’s leadership, the SEC’s Enforcement Division achieved notable victories, including a clean sweep in five federal district court cases. One of those was the landmark trial against Terraform Labs.

Additionally, the agency ramped up investor protections, barring 124 individuals from serving as officers or directors of public companies.

Gary Gensler praised the Division as a “steadfast cop on the beat,” while Acting Director Sanjay Wadhwa highlighted greater cooperation and self-reporting among market players.

“The Division of Enforcement is a steadfast cop on the beat, following the facts and the law wherever they lead to hold wrongdoers accountable,” outgoing SEC Chair Gary Gensler said in a statement Friday.

Gensler’s tenure as SEC Chair has been defined by his hardline approach toward crypto firms. A stance that hasn’t won him many fans in the industry. With his departure anticipated as former President Trump prepares to retake office, the crypto sector is largely welcoming the change.

Despite facing sharp criticism from retail traders and crypto advocates for his strict regulatory measures, the SEC’s latest report highlights Gensler’s significant impact as a crypto enforcer.

Stepping down on January 20, Gensler leaves behind a contentious legacy shaped by his firm grip on the rapidly evolving digital asset space.

Other Financial Remedies & Major Frauds Caught By SEC

The SEC’s enforcement actions in fiscal 2024 extended beyond crypto, with major settlements against prominent firms for various violations. Morgan Stanley agreed to a $249 million settlement for mishandling confidential information about large stock sales.

In another high-profile case, Macquarie Investment Management paid nearly $80 million over allegations of overvaluing thousands of illiquid collateralized mortgage obligations across advisory accounts.

Other notable penalties included FirstEnergy Corp.’s $100 million fine for its role in a years-long political corruption scheme.

Meanwhile, SAP resolved Foreign Corrupt Practices Act charges involving bribery by agreeing to pay over $98 million, with up to $59 million offset for related payments to the South African government.

The SEC spotlighted significant fraud cases in its latest enforcement report, including several high-profile Ponzi schemes.

In the crypto sector, the agency pursued key actions against Silvergate Capital for allegedly misleading disclosures about its BSA/AML compliance and against BarnBridge DAO for offering unregistered securities.

Major fraud busts included the $1.7 billion HyperFund pyramid scheme and the NovaTech scam, which impacted 200,000 investors. The SEC also broke new ground with enforcement targeting relationship investment frauds tied to the NanoBit and CoinW6 platforms.

The SEC’s Total Money Ordered for Fines and Penalties in Fiscal 2024

In 2024, the SEC’s enforcement landscape shifted notably, with 583 total actions reflecting significant declines across categories.

Stand-alone actions dropped 14% to 431 cases, follow-on administrative proceedings fell 43% to 93, and delinquent filing actions plummeted 51% to just 59.

Despite fewer cases, the financial impact was substantial, with record-breaking figures combining disgorgement, prejudgment interest, and civil penalties.

A major contributor was the $4.47 billion settlement from Terraform Labs and its CEO, Do Kwon. He is held liable for fraud after their blockchain ecosystem’s 2022 collapse wiped out billions in investor funds. This single case accounted for over half of the total penalties collected.

Excluding the massive $4.47 billion fine from Terraform Labs, the SEC’s total collections for 2024 would have amounted to $3.72 billion. This figure would have marked the agency’s lowest financial recovery since 2013 when it collected $3.4 billion in fines and penalties.

Of the total enforcement haul, $2.1 billion came from penalties, while disgorgement, repaying to harmed investors, which reached a record-setting $6.1 billion.

Big year for off-channel communication Penalties

The SEC continued its crackdown on major brokerage firms and investment advisors, imposing hefty penalties for failures in monitoring employee communications.

In fiscal 2024, the agency targeted 70 firms for violations involving “off-channel” messaging platforms like WhatsApp, used for business discussions outside official systems. These enforcement actions resulted in approximately $600 million in penalties.

As in prior years, some of the biggest names in wealth management were among those penalized, underscoring the SEC’s ongoing focus on enforcing communication compliance.
