CFTC Chair Calls on Crypto Exchanges to Register Voluntarily

CFTC News took a regulatory turn on Oct. 26 after Chairman Michael Selig outlined plans for voluntary federal crypto exchange registration. The Commodity Futures Trading Commission (CFTC) pursued the framework as Congress struggled to advance broader market legislation.

Selig said the agency was developing a registration pathway using existing statutory powers. The initiative would extend established derivatives-market safeguards to eligible cryptocurrency trading platforms.

However, the initiative remains under consultation. The CFTC has not adopted final requirements for the proposed registration framework.

CFTC Registration Will Establish Gold Standard Oversight on Crypto Markets: Selig

The CFTC is part of the voluntary registration that the regulator unveiled for public comment a few days ago, Regulation CTX and CAM. Under the proposal, crypto exchanges offering derivative trading can register with the CFTC for a federal license.

The agency argued that such federal registration will ensure uniform oversight of the crypto market. Crypto exchanges that register must comply with CFTC standards designed for crypto.

According to the CFTC chair, it is important to have regulations in place for crypto trading. He noted that this is necessary for market protection and preventing another FTX.

However, he acknowledged that the CFTC cannot mandate that crypto exchanges register with it, as such a requirement would require congressional legislation. Still, he noted that the proposals create a federal option for registration.

Selig believes that the federal registration pathway that is being proposed would guarantee consumer protection because the CFTC is well-equipped to do the job. He noted that CFTC regulations are time-tested, with the agency having enforced the statutes for 50 years.

“The CFTC regulations have worked well for generations. They have been in actually since the twenties and are some of the earliest market protection,” he said.

US Regulators Double Down on Crypto Regulations

Meanwhile, Selig’s statement reflects the broader position of US regulators on the crypto industry. Since the setback of the Clarity Act in September, US regulators, particularly the SEC and CFTC, have released several proposed rules for the industry.

Industry stakeholders had predicted this to be the next step in US crypto regulation once it became clear that the Clarity Act would not pass.

However, it is unclear whether their efforts will survive the President Trump administration, especially if the Democrats take over in 2029. Many believe that any hope of crypto legislation during the Trump administration may be dead if Democrats take control of the House, as is highly anticipated.

Still, the Trump administration has achieved one major crypto win with the GENIUS stablecoin Act. The Office of the Comptroller of the Currency (OCC) recently issued its regulations to implement the Act, which are set to take effect by January 2027.

OCC on Monday also called on community banks to apply for permission to issue stablecoins, noting that it wants them to help shape the future of payments. The agency has not opened the application process for stablecoins issuers.
