- French authorities are investigating Binance for alleged money laundering and tax fraud from 2019 to 2024.
- Binance faces global legal scrutiny, including SEC charges and a $4.3B penalty for AML violations.
- Users claim financial losses, alleging Binance misled investors and operated without approvals.
French authorities have initiated a thorough legal investigation against Binance, the world’s largest cryptocurrency exchange. The company has been accused of money laundering, tax fraud, and other offenses.
The Paris Public Prosecutor’s Office’s Economic and Financial Crime section, JUNALCO, leads this probe. It raises worries about alleged illicit operations with Binance in European Union countries.
The investigation, covering the period from 2019 to 2024, also includes allegations of money laundering linked to drug trafficking.
Scope of Allegations and Timeline
The French probe follows complaints from users who claim financial losses due to alleged misinformation provided by the platform. Additionally, users alleged that Binance operated without securing the required regulatory approvals.
According to JUNALCO, these issues triggered an in-depth examination of the company’s operations in France and the EU.
Recall that in June 2023, a preliminary investigation into Binance addressed charges of illegal canvassing and aggravated money laundering. The charges also include unauthorized operations as a virtual asset service provider.
This judicial escalation follows earlier claims of unauthorized practices and deepens scrutiny over the platform’s compliance with French regulations.
Compliance Efforts and User Concerns
Per Reuters, Binance claims to have made significant advancements in anti-money laundering (AML) measures and know-your-customer (KYC) checks. They have also paid significant attention to employee training.
The platform is dedicated to worldwide regulatory norms and stresses user information security. It only exchanges data with authorities when necessary.
However, user complaints in France have raised concerns over losses linked to alleged misleading communications. France’s JUNALCO noted that these issues and allegations of unauthorized trading practices contributed to the scope of the judicial investigation.
Global Regulatory Scrutiny Intensifies
Binance has faced global regulatory challenges, with notable actions in the United States. Last year, U.S. prosecutors described Binance’s approach as a “Wild West” model, welcoming illicit activities.
They accused the platform of failing to report over 100,000 suspicious transactions. This included links to designated terrorist organizations.
Binance founder and former CEO Changpeng Zhao was found guilty of violating US anti-money laundering laws. Following this, he received a four-month prison sentence.
The exchange also agreed to pay $4.3 Billion in penalties. France’s investigation follows the US SEC filing of 13 charges against Binance and Zhao. These charges included operating an unregistered securities exchange and failing to restrict US customers.
Meanwhile, the US Supreme Court allowed a separate lawsuit against Binance. This involved accusations of selling unregistered tokens that suffered significant losses.
At the same time, other nations have escalated legal actions against Binance. Australia’s corporate watchdog filed a lawsuit against Binance’s local derivatives business. They alleged the exchange of misclassification of retail customers as wholesale clients.
Heightened Scrutiny Amid Crypto Recovery
Per Reuters, the Financial Action Task Force (FATF) has warned about the risks of crypto. They are concerned about these digital assets becoming a haven for illicit financial transactions.
These warnings come amidst a broader resurgence in crypto markets, driven by high-profile endorsements and renewed investor interest.
However, the 2022 collapse of several crypto firms highlighted the potential for fraud and misconduct within the industry. This left millions of investors with heavy losses.
Despite the recent market recovery, regulatory bodies worldwide continue to intensify scrutiny over platforms like Binance. France’s investigation represents a growing trend of enforcement actions aimed at addressing alleged gaps in compliance within the crypto sector.
Meanwhile, Binance maintains its stance of cooperation, contesting the allegations and pledging to fight the charges.
